Terms and Conditions

For ordering g.tec hardware and software from g.tec medical engineering GmbH, Sierningstrasse 14, 4521 Schiedlberg, Austria; g.tec neurotechnology USA, Inc., Albany, New York, USA; or g.tec neurotechnology Hong Kong Limited, Hong Kong (collectively referred to as g.tec).

COVERAGE

  • The g.tec terms and conditions apply to all business conducted with g.tec. No other terms or conditions are accepted.

ORDERS

  • Hardware and software orders are placed through a g.tec sales agent or an approved g.tec distributor after an offer has been received.

HARDWARE/SOFTWARE VERSIONS

  • After the order is placed, a specific hardware and software version will be delivered.
  • The delivered hardware version will function only with its corresponding software version.

PAYMENT

  • Payments can be made by MasterCard, Visa, Maestro, bank wire transfer, or check.
  • Payments must be made within 30 days of receiving the devices.
  • A prepayment is required according to the issued offer.

PRICING

  • Prices are normally quoted in EUR. In the USA, prices are quoted in USD, and in Hong Kong in HKD, and are valid only within the respective territory.
  • Delivery costs are added to the quoted prices.

ORDER CONFIRMATION

  • After receiving the order and payment, g.tec may issue a purchase order confirmation to finalize the sales contract. If the purchase is not accepted, no confirmation will be issued and the payment will be refunded.
  • The goods will be shipped within 12 weeks after g.tec accepts the purchase order. If a longer delivery time is required, the customer will be informed when the purchase order confirmation is issued.

SHIPPING

  • Orders are shipped from g.tec medical engineering GmbH, Herbersteinstrasse 60, 8020 Graz, Austria. In the USA, orders are shipped from g.tec neurotechnology USA, Inc., Albany, New York.
  • Deliveries are sent ex works (EXW according to Incoterms 2000).
  • Shipments usually take 7–14 business days. Delivery times may be longer during local holidays due to reduced operations of manufacturers and couriers.
  • g.tec does not accept liability for delayed shipments.
  • International recipients may be subject to import taxes, customs duties, and fees charged once the shipment reaches their country. These costs are not included in the item price or shipping charges and must be paid by the customer.
  • Customs clearance may be required and can cause delays beyond the original delivery estimate.
  • Customs offices in some countries may require the importer of record to provide specific identification before releasing a shipment. An identification number may be requested.
  • Ensure all delivery information is correct, as changes cannot be made once the order has been submitted.
  • If you abandon your shipment or fail to pay duties and taxes, you are not entitled to a refund or replacement, and any reshipment fees must be paid by you.
  • Software is delivered electronically to your account upon receipt of payment if the purchase is completed.
  • Cancellations must be requested within 24 hours of placing the order and can only be processed if the order has not yet been released to the factory for fulfillment.
  • In cases of unforeseen events or circumstances beyond the parties’ control—including force majeure such as armed conflicts, official interventions, transport delays, customs delays, transit damage, energy or raw material shortages, labor disputes, or failure of key suppliers—the agreed delivery period is extended by the duration of the disruption. These conditions apply whether they affect g.tec or its subcontractors. If a contract cannot be fulfilled due to such circumstances, g.tec is released from its contractual obligations.
  • The risk of unforeseeable deterioration or loss of the goods transfers to the customer once the parcel service takes possession of the package.

PARTIAL DELIVERY

  • g.tec has the right to make partial deliveries and invoice them, following prior consultation with the customer.

SOFTWARE & HARDWARE REFUND POLICY

  • g.tec does not permit returns or offer refunds for software.
  • g.tec does not permit returns or offer refunds for hardware.

WARRANTY

  • Warranty is 12 months.
  • Electrodes and gel are consumables. Use only g.tec parts to operate the device.
  • g.USBamp and g.HIamp include a 5-year warranty.
  • Unicorn Hybrid Black has a 6-month warranty within the EU and a 30-day warranty in other countries.
  • The warranty is void if anyone other than a g.tec employee opens or disassembles any components.
  • The warranty applies only to devices used correctly.
  • g.tec hardware components are electronic devices, sometimes with an integrated Li-Ion battery, and must be handled according to the User Manual.

REPAIR/REPLACE POLICY

  • Please send a clear photo or video of the damaged or defective product.
  • g.tec will then send you an RMA number and the corresponding RMA documents for returning the device for repair.
  • Returns without an RMA number will not be accepted.
  • The customer will be informed of the repair costs before any work is carried out.
  • The repair will only begin after the customer confirms acceptance of the costs.
  • Shipping costs are billed to the customer.

SOFTWARE ERRORS

  • Software must be be reported to support@gtec.at.

LIABILITY

  • Liability for indirect damages, lost profit, economic loss, service interruptions, data loss, loss of interest, and damages resulting from third-party claims against the customer is fully excluded.
  • Any problems must be reported within 7 days after the receipt of the goods.
  • Any issues must be reported within 7 days of receiving the goods. Failure to do so may affect the warranty.
  • Outside the product liability act, g.tec’s liability is limited to intentional misconduct and gross negligence.

PROPERTY RIGHT

  • g.tec holds all property rights of the g.tec hardware and software components.
  • Any reverse engineering or copying of the device is prohibited.

COMPLIANCE RULES WITH YOUR INSTITUTION

  • g.tec medical engineering GmbH never asks for personal access data such as passwords, PINs, or other security-relevant information.
  • If you receive such a request—especially by email, phone, or other communication channels—assume it is a spoofing attempt. These fraudulent actions aim to steal your personal data. Do not respond to such requests.
  • Contact us directly through our official communication channels (+43 7251 22240 or support@gtec.at) to report the incident.

PLACE OF VENUE AND APPLICABLE LAW

  • The place of venue is Austria, Landesgericht Graz.
  • The United Nations Convention on Contracts for the International Sale of Goods does not apply.
  • Applicable law: Austrian law (excluding the United Nations Convention on Contracts for the International Sale of Goods).

DISPUTE RESOLUTION

  • Alternative Dispute Resolution in accordance with Art. 14 (1) ODR-VO and § 36 VSBG. The European commission provides a platform for online dispute resolution (OS) which is accessible at ec.europa.eu/consumers/. We are not obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board.
